W. Va. Code § 18B-1-6
This rule applies institution-wide and supersedes any conflicting WVSOM policy, procedure, handbook, or code of conduct.
The purpose of this rule is to provide the WVSOM administration with flexibility in addressing institutional requirements set forth in WVSOM’s policies, procedures, handbooks, and codes of conduct due to the state of emergency and precautionary rules put in place by federal and state officials caused by the coronavirus pandemic (COVID-19).
The WVSOM President and his/her designee(s) are given the authority to waive requirements set forth in WVSOM’s policies, procedures, handbooks, and codes of conduct, when those requirements are not, in the President’s discretion, possible to meet given the ongoing COVID-19 issues and operational restrictions.
Any such waiver becomes effective upon the date and time selected by the President and/or his/her designee(s), and terminates upon the shorter of (i) the termination date and time selected by the President and/or his/her designee(s) or (ii) the repeal of this rule by the WVSOM Board of Governors.
Any such waiver supersedes any conflicting WVSOM policy, procedure, handbook, or code of conduct.
When a requirement is waived pursuant to this Section 1, the President and/or his/her designee(s) must give notice to the individuals affected by the waiver.
The WVSOM administration shall develop procedures on re-opening the WVSOM campus in accordance with federal and state safety guidelines, requirements, and timelines. These procedures shall also include necessary precautions and safety measures for all employees, students, and visitors.
WVSOM employees, students, and visitors are required to follow the re-opening and safety procedures developed pursuant to this rule. Failure to comply with the procedures may lead to disciplinary action, up to and including termination of employment, expulsion, or immediate removal from campus, as applicable.
This rule will be implemented using applicable WVSOM policies and procedures, and WVSOM faculty, staff, and student handbooks.
